Mietvertrag Checklist for Every Renter
Clauses, Übergabeprotokoll, and Mieterbund when something feels unfair
No money before a signed Mietvertrag and a photographed Übergabeprotokoll; keep copies until your Kaution is back.
A friendly landlord is not a contract. Slow down at signing; your deposit depends on what you agree to in writing.
Whether you rent a WG room, a studio, or hospital adjacent housing, Germany expects a written Mietvertrag (rental contract). Verbal promises rarely count in court. Use Housing & Finding a Flat for search tactics; this guide is for every renter reviewing clauses before signature.
1) Before you sign: viewing and scam checks
- In person viewing: Walk through the flat. Refuse payment to foreign accounts before you see the keys.
- Warm vs cold rent: Kaltmiete is base rent; Warmmiete adds Nebenkosten advance. Your deposit is usually based on warm rent (often 2 to 3 months).
- Hausordnung: House rules on noise, pets, and guests may be attached. Sunday quiet and trash rules matter (see housing guide).

2) Clauses every tenant should understand
- Mietbeginn and duration: Fixed term (befristet) vs unlimited. Notice how renewal works.
- Kaution: Max three months cold rent in many cases; must sit in a separate account, not the landlord's private pocket.
- Mieterhöhung: Rent increases need legal form (Indexmiete, Staffelmiete, or local comparative rent rules). Vague "landlord may raise anytime" lines are suspect.
- Schönheitsreparationsklausel: Clauses forcing you to repaint on exit are often invalid if they ignore how long you lived there. Flag unfair wording before signing.
- Subletting and guests: WG rooms may forbid sublet without consent. Short guests are usually fine; long stays may need registration.

- Repairs: Landlord handles structural repairs; you report defects quickly in writing.
3) Übergabeprotokoll at move in and move out
The Übergabeprotokoll (handover protocol) records meter readings, key count, and existing damage. Without it, landlords may blame you for old scratches and keep Kaution.
- Photos: Every wall, floor, window, and appliance on day one. Date stamped.
- Meters: Electricity, gas, water readings written into the protocol.
- Keys: Number each key and remote.
- Signatures: Both sides sign. Keep your copy for the entire tenancy.
- Move out: Schedule a joint walkthrough, repair only damage beyond normal wear, and hand keys with a signed return line.
4) Nebenkosten and separate contracts
Your advance utilities in rent are not the same as your private electricity contract if you chose your own provider. After move in, read Nebenkosten & Winter Bills so year end heating statements do not surprise you.
5) When to use Mieterbund and free advice
Deutscher Mieterbund (mieterbund.de) is the national tenants association. Local chapters offer membership, model letters, and sometimes hotlines. Membership is optional but useful if you expect disputes.
- Before signing: Some cities offer contract checks for members or through Mieterverein.
- During tenancy: Illegal rent hikes, deposit delays over one month after move out, or entry without notice.

- Court: Small claims for deposit return often go through Amtsgericht; document everything first.
6) Notice periods and registration
Standard tenant notice is often 3 months to end of month, but contracts and local law vary. You must still ummelden (register change of address) at Bürgeramt when you leave. Landlords may require a Wohnungsgeberbestätigung for the next tenant.
